Overview
Erik Sardiña is an accomplished business litigator and legal advisor who has a broad range of experience handling complex commercial matters. His experience includes litigating and resolving business and corporate conflicts, directors and officers liability, and advising companies and executives on general legal issues, corporate governance, compliance, shareholder and member disputes, employment issues, environmental issues, securities, operations, data retention, insurance and overall risk management.
Mr. Sardiña’s diversified clientele includes closely held and publicly traded multi-national corporations, commodities and transportation companies, real estate investment funds, executives, directors and officers, public officials, public entities, and licensed professionals. He is highly regarded in all aspects of litigation from discovery through trial, as well as mediation and arbitration.
Mr. Sardiña’s represents clients in state and federal agency actions and successfully litigated cases for his clients in federal and state courts including the United States Supreme Court, New Jersey Supreme Court, and Court of Appeals for the Third Circuit. He is admitted to practice law in New York and New Jersey.
Outside of his work as a litigator, Erik assists management teams in conducting due diligence on behalf of food, drug, and cosmetic clients involved in brand and asset purchase transactions. He also advises clients on state and federal regulatory issues, including recalls, state regulatory complaints, and advising on communications with the FTC, FDA, CBP, and USDA.

Representative Matters
GBForefront, L.P. v. Forefront Mgmt. Grp., LLC, 888 F.3d 29 (3d Cir. 2018) – revived client’s breach of contract and unjust enrichment suit and abrogated Third Circuit precedent to establish new jurisdictional requirement that the citizenship of a traditional trust is determined differently than a business trust and is based solely on the citizenship of its trustee.
Heffernan v. City of Paterson, 668 Fed. App’x 435 (3d Cir. 2016) – successfully defended the constitutionality of a municipal employee policy prohibiting overt involvement in political campaigns on remand from the Supreme Court of the United States.
