Overview

Tracy Mainguy focuses her practice on labor and employment law, commercial litigation, and professional liability. Ms. Mainguy also counsels business clients and property owners on real estate and fiduciary liability matters, and advises on employee benefit plans and Employee Retirement Income Security Act (ERISA) regulatory compliance matters.

In her employment law practice, Ms. Mainguy represents clients in wage and hour disputes, Americans with Disabilities Act (ADA) claims, and wrongful termination matters, and advises employers regarding personnel policies, disciplinary matters and employment agreements. She provides counsel to a range of clients, including employee benefit trust funds and employers, on regulatory compliance under ERISA in addition to litigating claims relating to benefit denials.

In her litigation practice, Ms. Mainguy handles commercial disputes, creditors’ rights in bankruptcy and collection matters. When necessary, she uses alternative dispute resolution, trial and appellate experience to assist her clients to effectively resolve their claims.

Ms. Mainguy’s professional liability practice involves representing homeowners’ associations (HOAs), landlords, fiduciaries, and property owners in matters arising in breach of contracts, property disputes and negligence allegations including lack of fiduciary responsibility. Additionally, she litigates real estate matters in state and federal court on behalf of title companies and their insureds, landlords and property owners.

Before joining Kaufman Dolowich, Ms. Mainguy was a seasoned litigator serving businesses, insurers, and private entities across several law firms, handling matters involving employment law, commercial litigation, bankruptcy, real estate transactions and litigation, and professional and benefits liability.
