Overview
Michael Wilk focuses his defense practice on professional liability defense and employment litigation defense. Mr. Wilk has decades of experience resolving client matters through bench and jury trials, arbitrations, mediation, and litigation defending professionals.
Mr. Wilk defends accountants, attorneys, homeowners associations (HOAs), escrow officers, enrolled agents, insurance agents and brokers, and real estate professionals against claims of negligence, breach of fiduciary duty, fraud, and allegations brought under the Business and Professions Code and the Racketeer Influenced and Corrupt Organizations Act (RICO). Mr. Wilk has also been successful in various Courts of Appeal, including a high-profile HOA case. Additionally, he has represented both individual board members and board of directors of several non-profit corporations and HOAs in various lawsuits and California Attorney General investigations.
In his Lawyers Professional Liability practice, Mr. Wilk has defended hundreds of attorneys for negligence, breach of fiduciary duty, fraud, Unfair Business Practices, RICO violations, financial elder abuse, and malicious prosecution in state, federal, and bankruptcy courts as well as before the California State Bar.
In his employment defense practice, Mr. Wilk represents employers against wage and hour disputes, and claims of discrimination, harassment, and wrongful termination.
In his accountant E&O practice, Mr. Wilk has successfully assisted dozens of CPA’s and Enrolled Agents in obtaining abatement of penalties for their clients pre-suit, successfully defended hundreds of CPAs and Enrolled Agents in lawsuits or avoiding lawsuits against his clients entirely.
Prior to joining Kaufman Dolowich, Mr. Wilk practiced at another national law firm, local law firms, was a sole proprietor of his own practice, and taught law classes as an adjunct professor.
