Overview
Christopher Arcitio focuses his practice on commercial litigation, professional liability, general liability, and insurance coverage and litigation.
Mr. Arcitio handles general liability matters including motor vehicle defense on behalf of insurance carriers. He also has experience in large vehicle accidents and related claims involving bodily injury and property damage. Additionally, he defends clients in housing discrimination claims under the Fair Housing Act. Mr. Arcitio represents clients in New York State administrative proceedings including Fair Hearings before the Office of Temporary and Disability Assistance.
He also has experience in complex civil litigation lawsuits involving premises liability, catastrophic accidents, transportation, subrogation, elevator malfunctions, and New York Labor Law. He has litigated professional liability matters on behalf of physicians, nurses and hospitals.
During law school, Mr. Arcitio was a law clerk for a major insurance company and a securities litigation law firm. He served as President of the Asian Pacific American Law Students Association, as Editor-in-Chief for the school’s Commercial Division Online Law Report, and as Editor for their American Bankruptcy Institute Law Review. Mr. Arcitio competed in the National Asian Pacific American Bar Association Thomas Tang Moot Court competition, receiving the award for Best Brief and earning the title of Northeast Regional Champion.

Experience and Representative Matters
- Represented a carrier client’s insureds in a commercial general liability claim, which arose from a sidewalk incident on the neighboring property’s side, with plaintiff alleging that the insureds, a commercial property owner and its car wash tenant, were responsible for maintaining/repairing the sidewalk under the “special use” doctrine. During the investigation of the case, KD attorneys quickly discovered that plaintiff’s accident could potentially have been staged given that plaintiff could not explain how she obtained a photograph taken of her on the ground immediately after the fall. Subsequently, Mr. Arcitio and the KD team were successful in convincing the plaintiff and her attorneys to resolve the claim for a more favorable amount than the plaintiff was seeking, with co-defendant paying over 60% of the overall settlement.
- Represented an insurance carrier in a commercial general liability claim securing a favorable settlement at a private mediation. The claim involved a fall down the stairway in a New York City restaurant, wherein the plaintiff’s attorney initially attempted to argue that the plaintiff’s fall involved a slippery substance but later changed their theory of liability to a stairway itself being defect. The case was ultimately resolved at mediation.
- Represented an insurance carrier on behalf of a major NYC developer in a case where the plaintiff alleged she was caused to trip and fall from a metal anchor embedded and left in the sidewalk from a sidewalk bridge. Mr. Arcitio through mediation helped secure a favorable settlement at a fraction of the original amount the plaintiff was seeking.
- Represented an insurance carrier for property owner in lawsuit alleging personal injury claims. Plaintiff’s claim sought $7.5 million dollars. Following successful motion practice, the court precluded evidence of surgery performed six years after date of loss, and case resolved within the $1 million primary policy limits.
