Kaufman Dolowich’s Of Counsel Henry Norwood was quoted in a recent Law360 Healthcare Authority article, that addressed the headway some families seeking insurance coverage for youth wilderness therapy or fighting denials are making based on a handful of recent rulings backing claims that insurers may be violating federal law. The article also referenced a recent article in the Benefits Law Journal, authored by Mr. Norwood and Abbye Alexander, and Christopher Tellner, Co-Chairs of the Health Care/Managed Care Practice Group, which explored the challenging issue of identifying a proper analog to wilderness therapy. 

Mr. Norwood was quoted weighing in on a recent Moda Health decision, noting that the decision “continues a trend of courts being more sympathetic to plaintiffs in wilderness therapy coverage disputes. It also introduces a new potential theory of a Parity Act violation that he said could impact how health plans operate.” He touted the court ruling as “significant because it may open the door to precedent establishing that a health plan’s failure to recognize a wilderness therapy revenue code is itself a violation of the Parity Act.”
