Stephen Cunningham

Overview

Stephen Cunningham focuses his practice on professional liability and general liability. 

Mr. Cunningham’s work in professional liability practice, and in particular in defense of insurance agents and brokers, has spanned many years. He provides counsel to agencies and brokerages on all legal aspects of their businesses, including drafting producer agreement and reviewing agency contracts. He litigates contract disputes involving producers and insurance carriers. Mr. Cunningham’s general liability defense work includes defending clients in claims arising out of New York Labor Law 240 and 241, and in property and premises liability matters.

He is a seasoned trial attorney who has represented defendants throughout New York’s state and federal courts including many jury trials, and for cases in New Jersey and Rhode Island. He has successfully handled appellate cases in all four of New York’s Appellate Divisions, the New York Court of Appeals and the United States Second Circuit Court of Appeals.

After 16 years with the successful practice of Keidel & Cunningham LLP, he joined Kaufman Dolowich  in 2024 to better serve the needs of the business and insurance industries. Earlier in his career, Mr. Cunningham worked as an associate trial attorney with a New York City firm, specializing in railroad Federal Employers’ Liability Act (FELA) and environmental coverage litigation. He began his legal career as an Assistant District Attorney in Kings County, New York.

In addition to his client service, Mr. Cunningham has been a continuing education instructor for the New York State Insurance Department.
