Paul W. Daugherity

Overview

Paul Daugherity concentrates his practice on general liability defense, labor and employment law, and professional liability.

He handles matters involving products liability, construction, premises liability, medical malpractice, and professional liability claims against accountants, insurance brokers, architects, and real estate agents. Mr. Daugherity defends clients in matters involving misappropriation of trade secrets, breach of contract, and employment disputes before the U.S. Equal Employment Opportunity Commission (EEOC), Illinois Department of Human Rights (IDHR), Cook County Commission on Human Rights, Illinois Department of Employment Security (IDES), Department of Labor, and National Labor Relations Board (NLRB).

He represents real estate agencies in matters involving alleged breach of contract and fiduciary duty, as well as discrimination claims before the Illinois Department of Human Rights. Mr. Daugherity also represents accountants in cases alleging professional negligence and breach of fiduciary duty. He advises clients on non-compete and non-solicitation agreements, severance agreements, employee policies and handbooks, and reductions in force. Additionally, he defends directors and officers against claims alleging breach of fiduciary duty by investors.

In his products liability practice, Mr. Daugherity has defended manufacturers in numerous cases. He provides counsel and litigation defense to insureds in matters involving employee accidents involving heavy-duty industrial machinery, third-party contribution actions, and Illinois workers’ compensation cap issues. His experience includes litigating serious bodily injury and wrongful death claims involving alleged design and manufacturing defects. He has represented manufacturers of industrial machinery, construction equipment, heavy-duty mobile equipment, construction scissor lifts, train cranes, specialty trucking vehicles, and airport fire suppression vehicles.

Mr. Daugherity has extensive litigation experience, including serving as first and second chair in jury trials and handling binding arbitrations in multiple federal courts, before various administrative agencies, and throughout Illinois. He has represented a diverse range of clients, from individuals to Fortune 500 companies, focusing on their needs and working toward the best possible resolution of each matter.
