Brand-name companies have also been more aggressive in protecting their would-be territory, according to Christopher Nucifora, chair of Kaufman Dolowich & Voluck LLP’s intellectual property practice. “The generics are coming out with all these applications and the big pharmaceutical companies are fighting back and saying this can’t be had,” Nucifora said. “I think they’re making a little bit of stand.”
