Bloomberg Law’s Daily Labor Report, AI, Algorithm-Based Health Insurer Denials Pose New Legal Threat, quotes Henry Norwood, Esq., 4-8-2025

Kaufman Dolowich’s Henry Norwood was quoted extensively in a Bloomberg Law Daily Labor Report article on the growing risks for private insurers and employers regarding the use of artificial intelligence and algorithms in claims denials. 

Mr. Norwood is quoted in the Bloomberg Law article, “AI, Algorithm-Based Health Insurer Denials Pose New Legal Threat,” weighing in on recent cases including one involving a proposed class action regarding an insurer’s alleged use of a PxDx algorithm to assess claims with the insurer asserting it did not use PxDx on their medical claims. The insurer maintained that it sends disclosures to the doctor and patient whenever it uses PxDx. Norwood notes in the article that the revelation helped it defeat three plaintiff’s claim, but could easily go against them in a future case. He noted, “that could work to their advantage if they’re sued by a patient whose claim was not subject to the technology. Or it might work to their disadvantage because it then establishes that they did use the technology.”
