Michael A. Marcelli

Overview

Michael Marcelli concentrates his practice on consumer financial services, insurance defense and commercial litigation.

Within his consumer financial services practice, he represents agencies and creditors in individual and class-action matters arising under federal and state consumer protection laws including the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), and Telephone Consumer Protection Act (TCPA). 

In addition to this work, Mr. Marcelli regularly represents insurers in the defense of high-risk, complex litigation.

He also handles a broad spectrum of commercial litigation matters, including bad faith, homeowners’ association (HOA) and construction defect disputes, and personal injury actions. His experience further extends to products liability, subrogation, malpractice, premises liability, and toxic tort litigation. Mr. Marcelli routinely represents clients in state and federal courts in both bench and jury trials, as well as on appeal and in alternative dispute resolution forums.

Beyond his litigation practice, Mr. Marcelli advises businesses on entity formation, corporate compliance, and contractual matters.

Prior to joining KD, Mr. Marcelli practiced at a national firm, where he focused on insurance defense and commercial litigation, including California Invasion of Privacy Act (CIPA) cases. Before entering private practice, he pursued a career as a chemist and is a licensed patent attorney with substantial experience drafting patents and litigating trademark matters. His background also includes serving as General Counsel and Vice President of Legal Affairs for a litigation finance company and as a Prosecutor with the Yavapai County Attorney’s Office.
