Kaufman Dolowich’s Richard J. Perr, Co-Chair of KD’s Financial Services and Institutions Practice Group and Co-Managing Partner of the firm’s Philadelphia office, was recently quoted in Law360 discussing a closely watched Seventh Circuit case that could reshape how the Telephone Consumer Protection Act (TCPA) applies to text messages.
Mr. Perr told Law360 that recent Supreme Court decisions have created new opportunities to challenge longstanding FCC interpretations of the TCPA, including whether text messages qualify as “telephone calls” under the statute. He noted that the TCPA does not expressly reference text messaging, predicted the issue may ultimately require U.S. Supreme Court review, and advised businesses to continue obtaining consumer consent and scrubbing contact lists against do-not-call and reassigned-number databases while the law remains unsettled.
