Houston Business Journal, “Texas physicians gain protections under new noncompete law, but Houston doctors might face challenges,” quotes Erica LeBlanc, Esq., 9-11-2025

Posted Sep 12, 2025

Kaufman Dolowich’s Erica LeBlanc, Co-Managing Partner of KD’s Dallas and New Orleans offices, was recently featured in a Houston Business Journal article, where she provided insights on the implications of newly enacted legislation, effective early September, which clarifies the limitations on new and renegotiated physician non-compete agreements.

Ms. LeBlanc noted in the article that most of the draft employment agreements her office sees include both noncompete and arbitration clauses that leave disputes in private proceedings. She predicted that the directive for clear writing would make processes between employers and employees easier. She was further quoted as saying: “to me, it would cut down on the number of disputes. Before if you said ‘a reasonable amount of time (before a noncompete agreement can expire),’ well that could create a lot of difference on what’s considered reasonable. Whereas now if they say a reasonable amount of time is a year or less, that creates a lot more clarity and it’s easier to comply with from a standpoint of making sure something is enforceable.”
