The ruling could have a significant impact on the healthcare industry, says Henry Norwood, JD, an attorney with the Kaufman Dolowich law firm in San Francisco. “This ruling reminds me of the famous George Gershwin song — ‘you say tomato, I say tomato’ except we can’t just call the whole thing off and the stakes are higher than a dispute over phonetics,” he says. The Chevron doctrine was initially instituted to determine who had the right to decide if something is “tomato” or “tomato” — when it comes to the interpretations of ambiguous laws, Norwood says.
