Overview
Michael J. Weinberger focuses his practice on business and commercial litigation. He provides strategic counseling to businesses, homeowners associations, governmental clients and individuals across several business sectors including real estate, sales, partnership disputes, public works projects and creditors’ rights. This experience includes defense representation of homeowners’ associations and their officers and directors involving disputes concerning their fiduciary obligations and the interpretation of governing documents.
Mr. Weinberger is also an experienced appellate advocate. His experience covers areas as diverse as the enforceability of mandatory arbitration provisions, the California False Claims Act, homeowners association governance and the Davis-Stirling Act, and the force and effect of retail sales provisions under the Uniform Commercial Code.
Previously, Mr. Weinberger successfully practiced with Greenberg, Whitcombe, Takeuchi & Gibson, LLP and in 2022 the firm joined with Kaufman Dolowich LLP to better serve the needs of the business and real estate industries.
He previously practiced law at the Los Angeles Public Defender’s Office where he represented indigent defendants in all phases of criminal proceedings, including arraignment, felony preliminary hearings, and at trial. Prior to that, he was with KTBS Law LLP, focusing on business bankruptcy and restructuring, including representation of both corporate debtors and creditors’ committees.

Selected Significant Matters
- Represented a major public agency at trial in a multi-million-dollar contract dispute with a contractor over the retrofit and restoration of two venerable buildings for use as a cultural heritage center
- Represented homeowners association at trial and appeal against an attempt to dismantle the General Plan for the community and against tort claims, including breach of fiduciary duty, targeting the association’s volunteer directors
- Successfully appealed and obtained a reversal of a judgment of dismissal on a claim by a public agency against a contractor for violations of the California False Claims Act
- Successfully sought reversal of a summary judgment in sales litigation in which the California Second District Court of Appeal found that a retail seller of home building products can owe a duty of care to the owner of the building project and cannot necessarily disclaim warranties with pre-printed warranty disclaimers contained on sales receipts
- Represented a group of direct lenders in one of the largest community redevelopment projects in Los Angeles County, including obtaining legal title to the property and negotiations with diverse interests such as the former Community Redevelopment Agency of Los Angeles
- Strategic counsel to a major public agency in a seismic retrofit project for a prominent bridge
- Represented homeowners association in an indemnity action, successfully obtaining a temporary restraining order and preliminary injunction
- Represented businesses such as a major national retailer and others in defending preference and fraudulent transfer claims brought in business bankruptcies
- Represented a national publicly traded retailer of fine jewelry operating more than 130 stores in its reorganization efforts, including its overhaul of its cash-management system
